Public offer

This document is a public offer by ООО «ЛАКАБАНА ГРУПП» (the "Seller") setting out the terms of distance retail sale of prepared dishes and non-alcoholic drinks (the "Goods") via the website lacabanagroup.moscow (the "Website"), with courier delivery or pickup.

Under Art. 437 of the Civil Code of the Russian Federation, payment for an Order placed on the Website constitutes acceptance of this offer. Acceptance means full and unconditional agreement with all its terms.

"Customer" — an individual placing an Order via the Website.

"Goods" — prepared dishes and non-alcoholic drinks from the current menu published on the Website. Prices are shown on the Website before the Order is placed.

"Order" — a set of Goods placed and paid for via the Website with a chosen fulfilment method: courier delivery or pickup at the Seller's venue.

"Delivery Service" — a licensed third-party courier service engaged by the Seller to deliver Orders.

"Delivery Zone" — the area within 130 km of the Seller's venue. Deliverability of a specific address is checked by the Website when the Order is placed, including under the Delivery Service's rules.

"Minimum Order Value" — 500 (five hundred) rubles, excluding the delivery fee.

The Seller undertakes to hand over the paid Goods to the Customer (via a Delivery Service courier, or at the venue for pickup), and the Customer undertakes to accept and pay for the Goods and, where delivery is chosen, the delivery fee, on the terms of this offer.

The Seller engages the Delivery Service to perform delivery; the sale contract for the Goods is between the Customer and the Seller.

The Customer selects Goods from the menu on the Website and provides the fulfilment method, a contact phone number and — for delivery — an address within the Delivery Zone.

An Order requires the Goods subtotal to be at least the Minimum Order Value. Orders to addresses outside the Delivery Zone cannot be placed.

An Order is deemed accepted once confirmed by the Seller. Before the Order is sent to the kitchen, the Seller may contact the Customer to clarify details.

The delivery fee is calculated individually for each Order at the Delivery Service's rates, based on the delivery address and Order parameters, and is shown on the Website as a separate line before payment.

The delivery fee is paid by the Customer in full together with the Order. The Seller does not subsidise the delivery fee.

Orders are paid on a 100% prepayment basis in Russian rubles via a licensed third-party payment provider, before the Order is put into fulfilment. The Seller does not receive or store the Customer's bank card data. A fiscal receipt is sent to the Customer electronically in accordance with Federal Law No. 54-FZ.

Once confirmed, the paid Order goes to the Seller's kitchen. Estimated preparation and delivery times shown on the Website are indicative.

Delivery is performed by a Delivery Service courier. The Customer receives an SMS with the arrival window and the courier's contact phone, and can track the delivery via a link provided on the Website.

The Seller's obligation to hand over the Goods is fulfilled, and the risk of accidental loss of or damage to the Goods passes to the Customer, when the Order is handed to the Customer (for pickup — when the Order is handed over at the venue).

Distance selling of alcoholic beverages is prohibited by Russian law and is not carried out via the Website. The online-ordering menu contains no alcoholic drinks.

The Goods are perishable food products prepared to individual Order. Once an Order is confirmed, it cannot be cancelled by the Customer and payments are non-refundable. Russian law does not provide for the return of food products of proper quality.

If the Order cannot be handed over through the Customer's fault (the Customer is unreachable on the provided phone, absent at the address, or provided a wrong address), the Order is deemed fulfilled and payments are not refunded.

If the Order is not fulfilled through the fault of the Seller or the Delivery Service, the Seller will, at the Customer's choice, arrange redelivery or refund the amount paid in full.

Quality claims are accepted under the Russian Consumer Rights Protection Law via the contacts in the company details, within 24 hours of receiving the Order, with photographs attached.

The Seller undertakes to prepare Goods of proper quality, package them, and hand them to the Delivery Service courier (or hand them over at the venue for pickup) within the agreed times.

The Customer undertakes to provide accurate contact details and address, remain reachable on the provided phone during delivery, and accept the Order.

The parties are liable in accordance with the laws of the Russian Federation. The Seller is responsible for the quality and completeness of the Goods at the moment the Order is handed to the Delivery Service courier, and for fulfilment of the Order overall vis-à-vis the Customer.

The Seller is not liable for non-performance due to force majeure.

To perform delivery, the Customer's name, contact phone and address are shared with the Delivery Service. Personal data is processed in accordance with the Privacy Policy published on the Website. By accepting this offer the Customer consents to the processing of their personal data.

This offer is governed by the laws of the Russian Federation. The Seller may amend the terms of the offer; the current version is published on the Website.
